This route is for a person becoming self-employed, a working director or a partner in a Gibraltar business.

What must actually exist or be demonstrated: business plan, company, innovation, clients, contracts, economic activity, job creation or other substance?

A business application (registration and, where the activity needs one, a business licence) is required as well as the residency application; the applicant must be eligible, if required, for a Fair Trading Act 2023 licence (or regulation for a regulated business). In registering a business the Department of Business may consider job creation, in-demand skills, renting suitable office or commercial space, a positive tax filing history and future economic activity in Gibraltar.

A self-employed individual pursues a gainful activity for their own account and is not an employed person. If the applicant includes a spouse or civil partner, a deposit equal to the first-year social insurance contributions is payable. If residency is refused, the business must be restructured to operate without a Gibraltar-resident self-employed person, working director or partner, or its registration and any licence terminated.

The business application (registration and any licence) must be submitted and approved before the residency application. If the regulation 9 requirements are met the Authority issues a residence permit, valid for one year unless otherwise stated and renewed each year; on renewal the regulation 9 requirements must still be met except the age limit in regulation 9(1)(c) (55 or under), and deposit requirements do not apply to renewals. Gibraltarian Status can be applied for after 20 years for those becoming resident on or after 6 October 2025.
