What qualifying residence period is required and when does the period begin?

The Gibraltarian Status Act, as amended (amendment to section 9(f) with commencement 30 October 2025 in the consolidated text), requires residence in Gibraltar for a continuous period of twenty years immediately preceding the date of application. Government guidance states that the period is 20 years for new applicants who become resident on or after 6 October 2025 and 10 years for people who held a valid Civilian Registration Card or Permit of Residence and were in Gibraltar before 6 October 2025. The consolidated Act text does not state the 10-year period for earlier residents.

  • Searched the guidance page (5a932dd11f296e6d.txt) and Residency Regulations 2026 for which types of residence count towards Gibraltarian Status; only the start-date split (CRC/Permit of Residence before 6 October 2025) is given, placed in the years box.

What absence/continuity rules affect accumulation of the qualifying residence period?

Residence must be continuous for the whole qualifying period immediately preceding the application (twenty years in the current Act text; government guidance states 10 years for people who held a valid Civilian Registration Card or Permit of Residence and were in Gibraltar before 6 October 2025). The official source does not state which absences break continuity.

  • The residency guidance keeps a 10-year period for people resident with a valid CRC or Permit of Residence before 6 October 2025, which the consolidated s.9(f) text does not show.

What other major conditions apply, how is the status obtained, and what renewal, document-validity, retention or loss rules matter?

Gibraltarian Status is applied for through a process separate from applying for residency. The official source does not state the other conditions, how the application is decided, or any renewal, retention or loss rules.
