Limits of the record
  • Searched 84c30af77d296770.txt (Indefinite Residence Status Generally) and all other captures: no text states which family relationship (spouse of a Ghanaian or otherwise) qualifies for indefinite residence as a foreign spouse. The rights material (remain, visa-free entry, work) belongs to R5.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The checked official sources did not provide enough route-specific evidence to confirm who may sponsor the family member and the status the sponsor must hold.

Limits of the record
  • Searched 84c30af77d296770.txt and other captures: no statement of who sponsors a foreign spouse for indefinite residence or the sponsor's required status. The sentence on an IRS holder applying for a dependant permit for a child/dependant concerns a different mechanism.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

A marriage certificate must be attached as evidence of being a spouse. GIS also lists a support letter from the spouse and a birth certificate, a copy of the Ghanaian spouse's passport (bio-data and profession pages), and a marriage/divorce/death certificate where applicable. Where the marriage no longer exists, the status may still be granted on evidence that the marriage was contracted in good faith.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The applicant provides evidence of a personal tax clearance certificate or evidence of financial support from the spouse (for example a bank statement or a covering letter from employers), and evidence of immovable property where applicable.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

The foreign spouse applies on Form G after residing in Ghana throughout the 12 months before applying plus an aggregate of at least two years before that (reducible in special circumstances to six months and one year). The holder may remain indefinitely, enter without a visa and work without a work permit. The status is lost after more than 12 consecutive months away from Ghana, but separation, divorce or death of the spouse does not affect a status already held.
