What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

This route is for managers, specialists and trainee employees of an undertaking headquartered outside the EU who hold an ICT Card issued by another EU State that is valid in Germany for the duration of the application procedure, and who wish to work in a German unit within their undertaking for more than 90 days as part of an intra-corporate transfer.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

Yes. It is a transfer within the same undertaking or group of undertakings: the person takes up work in the German host entity and must present an employment contract, and where appropriate an assignment letter, valid for the duration of the transfer, stating the place and kind of work, remuneration and other terms, with evidence that the person can return to an entity of the same undertaking or group established outside the EU. The German host entity must inform the foreigners authority of changes, as a rule within one week.

What are the few decisive professional characteristics of the pathway: occupation, qualifications, experience, salary, skill level, shortage status, labour-market condition or equivalent?

The applicant must work as a manager (a key position mainly directing the host entity or a department), a specialist (specialised knowledge essential to the host entity, highly qualified with appropriate professional experience) or a trainee employee (a university graduate on a graduate training programme). The applicant must hold an ICT Card issued by another EU state that is valid in Germany throughout the procedure, and the transfer must last longer than 90 days. The card is not granted if the person will stay longer in Germany than in other member states during the transfer.

What work does the permission allow? Is the holder tied to an employer, occupation or sector? Can family accompany where clearly established?

The Mobile ICT Card is for working in a German unit within the holder's undertaking for more than 90 days; the holder takes up work in the host entity in Germany as a manager, specialist or trainee employee and must present an employment contract and, where appropriate, an assignment letter valid for the duration of the transfer. If the application is lodged from abroad 20 days before coming to Germany, the person may already come and work for up to 90 days within 180 days pending the decision. When a Mobile ICT Card is issued in Germany, the holder’s spouse or life partner and any minor, unmarried children also receive a residence permit for the same period.

How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

The application may be refused if the maximum duration of the intra-corporate transfer has been reached: for managers and specialists, the duration of the transfer but no more than three years; for trainee employees, no more than one year.
