What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

It is for managers, specialists and trainee employees of an undertaking headquartered outside the EU who already hold an ICT Card from another EU Member State and work in a German unit within their undertaking. For employment stays of up to 90 days within 180 days no German residence title is needed; working in a German unit for more than 90 days requires a Mobile ICT Card in Germany.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

Yes. The transfer must be within the same undertaking or group of undertakings. The host entity in the other EU Member State (or the host facility in Germany under a power of attorney) notifies the Federal Office for Migration and Refugees, forwarding a work contract and any assignment letter and proof that the German entity belongs to the same undertaking or group. The notification must be received in full before entry.

What are the few decisive professional characteristics of the pathway: occupation, qualifications, experience, salary, skill level, shortage status, labour-market condition or equivalent?

The worker must be a manager in a key position, a highly qualified specialist with essential specialised knowledge and appropriate professional experience, or a trainee employee with a university degree on a graduate training programme. Entry is denied if pay during the transfer is less favourable than for comparable German employees, or if the person has been in the EU for more than three years (more than a year for a trainee employee).

If entry and residence are denied within the allotted time, the foreigner must cease the economic activity without delay. How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

Stays are limited to 90 days within 180 days while the other Member State's ICT Card remains valid. If no refusal is made within 20 days of the notification, the Federal Office for Migration and Refugees issues a declaratory certificate.
