Which family relationships qualify?

A life partner qualifies where the EU citizen has a credibly demonstrated, durable relationship with that partner that excludes another relationship of the same kind, and neither is married to or in a registered partnership with the other.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The sponsor is an EU citizen; the right is conferred on application to the partner who is not an EU citizen or otherwise free-movement entitled, and the EU citizen must be going to live with the partner in Germany on a non-temporary basis. This also applies to EEA nationals (Norway, Iceland, Liechtenstein), Swiss nationals as provided by the EU-Swiss agreement, and Germans who exercised EU free movement.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Besides passport and registration certificate, the authority requires proof of the circumstances establishing a durable relationship between the EU citizen and the partner.

The right is granted on application after a thorough examination of personal circumstances; the partner receives a residence card for close persons intended to be valid five years and may work. After five years of continuous lawful residence with the EU citizen a permanent right of residence is acquired.

    (7) Bei Verleihung des Rechts nach § 3a Absatz 1 stellt die zuständige Behörde eine Aufenthaltskarte für nahestehende Personen, die nicht Unionsbürger sind, aus, die fünf Jahre gültig sein soll. Die Inhaber des Rechts dürfen eine Erwerbstätigkeit ausüben.
