Which family relationships qualify?

Regulation 15 does not list qualifying relationships: a dependant's pass may be issued for a dependant who, by reason of age, disability or any incapacity, is unable to maintain himself adequately or for some other reason relies on the applicant for maintenance. Where the applicant holds an entry permit, particulars of his wife and children (being dependants) may, at an immigration officer's discretion, be endorsed on the entry permit.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The applicant (sponsor) must be lawfully in or entitled to enter Swaziland (Eswatini) as a citizen of Swaziland, as a holder of an entry permit, as an exempted person, or as a person to whom section 4(3) of the Immigration Act applies; that person applies to the Chief Immigration Officer in Form 6 for a dependant's pass for any of his dependants.

(1) A person, who is lawfully in or entitled to enter Swaziland by virtue of — (a) being a citizen of Swaziland; or (b) having been issued with an entry permit; or (c) being an exempted person; or (d) being a person to whom section 4(3) of the Act applies, may make an application to the Chief Immigration Officer, in Form 6 in the First Schedule hereto for a dependant’s pass for any of his dependants.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

One application (Form 6) is made for each dependant; the applicant states his relationship to the dependant, and proof of birth and/or marriage must be attached. The Chief Immigration Officer must be satisfied that the dependant depends for maintenance on the applicant.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

A dependant's pass entitles the dependant to enter within the periods specified in it and to remain during its validity, subject to its terms and conditions. It is deemed expired thirty days after the dependant stops being dependant on the applicant, the applicant fails or is unable to maintain the dependant, the applicant leaves in circumstances suggesting a non-temporary absence, the dependant engages in employment, or the applicant dies. Exception: a pass issued to a married woman living with her husband who has been issued a Class B entry permit stays in force for its unexpired validity even if she works under that permit or stops doing so. A dependant's pass cannot be cancelled without the prior approval of the Minister. The official source does not state a path to longer-term status.

    Provided that nothing in this regulation shall render invalid a dependant’s pass issued in respect of a married woman who is living with her husband and who has been issued with an entry permit of class B and such dependant’s pass shall, subject to the provisions of the Act, be of full force and effect for the unexpired period of its validity notwithstanding that such married woman engages in any employment under the entry permit or has ceased to engage in such employment.
