What exactly is the official special programme/status and why does it exist?

Transitory residence: a short residence subcategory for seasonal workers, cross-border workers, transnational service workers, members of international humanitarian missions, medical brigades, people doing unpaid social-benefit work, and others admitted by DGME on humanitarian grounds.

    Art. 104.- Las personas extranjeras que ingresen al país como residentes transitorios, podrán ser admitidas en las siguientes calidades: 1) Trabajadores de Temporada. 2) Trabajadores Transfronterizos. 3) Trabajadores Transnacionales de Servicio. 4) Persona extranjera que colabore con una misión internacional que preste asistencia humanitaria en el país. 5) Personas extranjeras de brigadas médicas. 6) Persona extranjera que realice ad honoren cualquier actividad de beneficio social comprobado. 7) Las demás que la Dirección General estime convenientes por razones humanitarias, de conformidad con los instrumentos internacionales de derechos humanos.

Which specific population, role, circumstance or historical/legal situation does it cover?

The DGME form covers foreigners of any nationality who are transnational service workers, collaborate with an international humanitarian mission, belong to medical brigades, or carry out unpaid (ad honorem) proven social-benefit activity.

What circumstance, event, relationship, nomination, invitation or status activates access?

For transnational service workers, access is triggered by being temporarily transferred to El Salvador by a foreign-based employer with which they have an employment relationship, either to perform a contract between that company and a service recipient in El Salvador, or to work at a site in El Salvador of the same company or its group. The official source does not state a separate triggering event for the other transitory categories.

    Art. 107.- Para efectos migratorios se entenderá por personas trabajadoras transnacionales de servicio, las personas extranjeras que son trasladadas temporalmente a El Salvador y que tienen una relación laboral con una empresa establecida fuera del territorio salvadoreño, en los supuestos siguientes: 1) Cuando el desplazamiento se produzca por cuenta y bajo la dirección de la empresa, en ejecución de un contrato celebrado entre la misma y el destinatario de la prestación de servicios, esté establecido o ejerza su actividad en El Salvador. 2) Cuando se trate de desplazamientos a centros de trabajo en El Salvador de la propia empresa extranjera o de otra empresa del grupo de que forme parte.

What sponsor, authority, nomination, certification, evidence or other step must occur before the status can be obtained?

The application must be filed by the legal representative or attorney of the requesting entity with a notarised signature (for a public institution, the head's signature and seal).

What immigration status and rights result, how long do they last, can family be included, and what happens if the special qualifying circumstance ends?

Transitory residence is granted for six months (transnational service workers up to one year). It does not create a right to definitive residence, but holders may change category while in the country if they meet the requirements. The official source does not state whether family can be included.
