Residence under the Ukraine Special Act — Family Member

If certain requirements are met, you can be granted a residence permit under section 2 of the Special Act as a close family member to a person in Denmark, who has been granted a residence permit under section 1 of the Special Act.

in Denmark that is valid until 17 March 2027.

cohabiting spouse,

cohabiting partner,

unmarried child under the age of 18,

close family member who has resided with the person and who were supported by the person, or

another close family member who is residing and has a family life worth of protection with the person who has been granted a residence permit under the conditions in section 1 (e.g. parent to a child under 18 years).

It is a requirement that the family life consisted on 24 February 2022.

If you are staying in Denmark, and you are either a Ukrainian citizen or a recognized refugee in Ukraine, you should not apply as a family member.

An application for a residence permit under section 2 may be submitted in Denmark or outside the country.

If you are in Denmark, you have to book an appointment to submit your application and have your biometrics recorded and be identity checked at the Immigration Service's Citizen Service.

If you are abroad, you can submit the application to a Danish diplomatic mission (embassy), where you will also have to have your biometrics recorded

You can apply concurrently with the family member applying for a residence permit under section 1 of the Special Act.

Documentation of your relationship with the person in Denmark (e.g. marriage or Certificate of Personal Data (Birth Certificate))

You are entitle to work in Denmark, when you have been granted a residence permit.
