Which citizenship, status or regional agreement creates the person's right to move/reside?

The Withdrawal Agreement protects qualifying family relationships with a UK citizen who holds residence in Denmark under that agreement. For later-arriving family, the relationship generally must have existed before 31 December 2020 and still exist when applying, with specific protection for children born or legally adopted afterwards.

Under which circumstances can the person reside: worker, self-employed, student, jobseeker, self-funded person or another recognised basis?

The UK sponsor must reside in Denmark under the Withdrawal Agreement as a worker, student, self-employed person, person with sufficient funds or permanent resident. The family relationship must be genuine, and applicants must sign the prescribed declaration.

Your relationship must be genuine and not established solely for the purpose of obtaining a residence based on the Withdrawal Agreement. You must as part of the application sign a sworn declaration under the penalty of perjury attesting to this.

What entry, registration or residence-document formalities remain?

The official process uses BR1 with passport and relationship evidence, plus relevant proof of support or dependency. Biometrics must be recorded within two weeks of submission. The page retains a 31 December 2023 deadline and special-excusable-circumstances wording, so the filing deadline for a family member first joining after that date remains to be confirmed.

Limits of the record
  • The current filing deadline for a post-2023 later-arriving protected family member requires official clarification; the page also says qualifying family may join at any time after the transition period.

Which non-member-country family members can accompany or join, and what broad rights do they receive?

Protected close family includes spouses, cohabiting partners and children under 21. Parents and children over 21 must be financially supported or dependent. Later-arriving extended relatives such as siblings or cousins are not protected by the same rule. Children born or adopted after the transition period have specific under-21, financial-support and custody conditions.

When do permanent/long-term rights arise and what continuity, absence or retention conditions matter?

A qualifying family member receives a five-year residence card and may remain while the residence conditions continue. After five consecutive years, permanent residence may be sought. Once permanent rights are obtained, the original residence basis no longer has to continue, but more than five years outside Denmark can cause those rights to lapse.
