Which family relationships qualify?

A resident may request a family residence permit for a spouse or partner. The current official spouse/partner checklist expressly covers a marriage certificate and, for a cohabiting couple, a notarial cohabitation agreement concluded in the Netherlands or BES islands plus proof of each person’s unmarried, divorced or widowed status.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The main applicant acts as guarantor and signs the guarantee declaration. The checklist asks for a copy of the guarantor’s current residence permit, Declaration Van Rechtswege or Declaration Niet van Toepassing, except for persons covered by article 1(a) LTU. Employer or business evidence is requested according to the guarantor’s situation.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

For marriage, provide the marriage certificate; for a marriage abroad, the page also calls for its registration at the Public Affairs Department, except that a couple immigrating together submits only the marriage certificate. For cohabitation, it asks for a notarial agreement concluded in the Netherlands or BES islands and proof of both parties’ unmarried, divorced or widowed status. Certificates may require legalisation or apostille according to country of issue, with EU countries exempted.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The sponsor must show sufficient financial funds for each family member. For this spouse or partner first application, the checklist asks for a signed guarantee declaration and proof of the guarantor’s current residence status where applicable, plus employer or business documents according to the guarantor’s situation. For a guarantor with their own company, it also lists an original Tax Inspectorate declaration of fixed taxable income of at least XCG 36,000 from two years earlier. The separately published monthly family standards distinguish a Dutch-citizen sponsor (XCG 1,500 gross for the spouse) from a foreign sponsor (XCG 3,000 gross for the spouse), plus XCG 250 per child aged 0–5, XCG 350 aged 6–11, and XCG 500 aged 12 or above; when only children apply, the first child takes the partner’s place in the standard amount. The XCG 36,000 declaration is a distinct checklist item, not a universal monthly threshold.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

A residence-permit application is submitted for the spouse/partner with the relevant family checklist and scanned PDF documents. The Admission Office says it has four months to decide and that a first applicant must await the decision abroad. Renewal may be submitted from four months before expiry. Under the policy effective 1 April 2026, a new permit may be requested for up to three years with each year’s fees paid in advance, and a dependent family member admitted for reunification or formation follows the principal applicant’s permit duration. A timely renewal of an earlier qualifying two-, three- or five-year permit can retain the same duration and conditions under the policy’s transition rule; a late filing after the grace period loses that accrued entitlement. Ten years of uninterrupted lawful residence is one listed ground for a separate indefinite permit, not an automatic conversion of this family status.

Afhankelijke gezinsleden (in het kader van gezinshereniging of gezinsvorming) volgen de hoofdaanvrager wat betreft de duur van de vergunning. Het is derhalve niet mogelijk dat een gezinslid een vergunning voor drie jaar verkrijgt, terwijl de hoofdaanvrager een vergunning voor slechts één jaar heeft. Ook hier geldt dat per aangevraagd jaar leges en retributies verschuldigd zijn (aantal jaren × leges en retributies).
