What investment option or options qualify?

There is no menu of investment products. 'Résident permanent' means the foreigner, or the members of his family, whose establishment on the national territory is useful to Burundi, in particular through the creation of employment and/or the bringing of a significant investment.

  • The only test is the qualitative 'un investissement important' in the Art 4 definition of 'résident permanent'; no investment figure, tier or threshold is stated anywhere in Loi n°1/25. The only money amounts in the law are the criminal fines of Chapter XVI (Arts 128-137), expressed in Burundian francs, which are penalties and not investment thresholds. Art 23 leaves the cost of travel documents and visas to a joint ordinance of the Ministers of Migration and Finance, and Art 31 leaves the amount of the establishment bond to an ordinance of the Minister responsible for migration; neither ordinance is reproduced in this Bulletin. How long must the investment be maintained and what continuing ownership, investment or physical-presence conditions are important?

The Art 4 definition states only that the establishment must be 'utile au Burundi'; Art 25(1) allows the CCER to rule on the 'déchéance de la qualité de résident permanent' without saying on what grounds, and Art 41's expulsion grounds are general and not tied to an investment. Which family members can be included where officially stated, and what broad residence/work rights result?

The law defines a permanent resident as the foreigner or the members of his family whose establishment in Burundi is useful to the country, in particular through job creation and/or a significant investment. Persons, or members of their families, who can show permanent-resident status are exempt from the entry visa but must present an official identity document. The official source does not state which family members are included or what work rights result.

The status obtained is that of 'résident permanent', and granting it to foreigners - like granting refugee or stateless status - is the responsibility of the Commission Consultative pour Etrangers et Réfugiés. The official source does not state a renewal cycle, a citizenship direction or what happens to the investment.
