What exactly is this: asylum, temporary protection, humanitarian admission, resettlement or another protection mechanism?

Temporary protection is an urgent and temporary group mechanism for a mass influx, not an individual asylum decision or a visa. The Council of Ministers establishes it by decision on a Ministry of Security proposal, after consultations with UNHCR and other relevant international organisations. The Ministry then grants the status under that decision. The law alone does not show that a particular temporary-protection decision is currently active.

Which population, circumstances or geographic group does the mechanism cover?

The law covers foreigners arriving en masse who have left their country of origin and cannot return because of armed conflict or systematic and general human-rights violations. It also covers foreigners who were already in Bosnia and Herzegovina when those circumstances arose and are temporarily unable to return. The Council of Ministers’ decision determines the number of people protected and any grounds for increasing that number. No current nationality-specific group is established by the law alone.

Where can protection be requested, and is this a direct application, border/in-country request, referral or other process?

There is no ordinary individual visa application described for this group mechanism. The Council of Ministers must first issue a temporary-protection decision on the Ministry’s proposal; the Ministry of Security grants protection to people covered by that decision. What happens after the request: registration, family handling, major support and rights where officially stated?

People granted temporary protection have statutory rights to stay, basic living conditions and accommodation, an identity document, primary health care, primary and secondary education, free legal aid, labour-market access, family reunification and guardianship for an unaccompanied minor or legally incapacitated person. Protection is initially granted for one year and automatically extended twice by six months; the Council of Ministers may add one year if the reasons remain. A person may also apply for asylum while keeping these rights. These provisions do not set the terms of any currently active group decision.
