What absence/continuity rules affect accumulation of the qualifying residence period?

Third-country nationals who are family members of EEA citizens with a right of residence under EU law, and who meet the conditions in Section 52(1)(1) to (3) of the Settlement and Residence Act (NAG), acquire the right of permanent residence after five years of continuous lawful residence in Austria; Section 53a(2) NAG applies when calculating the five-year period. Continuity of residence in Austria is not interrupted by absences of up to a total of six months a year, by absences to perform military obligations, or by one single absence of at most twelve consecutive months for important reasons such as pregnancy and childbirth, serious illness, study, vocational training or a professional posting.
