Which family relationships qualify?

The Family Member title is for family members of Austrian nationals. Family members are spouses, registered partners and unmarried minors, including adoptive and step children. Spouses and registered partners must be 21 years of age or older when applying; children must be under 18 years of age at the time of application. Other dependants of Austrian nationals fall under a separate title (Settlement Permit – Dependant).

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Where applicable, the documents required include a marriage certificate, divorce certificate, certificate of registered partnership, certificate of dissolution of a registered partnership, adoption papers, evidence or certificate concerning the family relationship, and a death certificate; a birth certificate or similar document is required for children with first applications.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The applicant must have a fixed and regular income to meet living costs without welfare aid, equal to or above the standard income rate; in 2026 this was € 1,308.39 for singles, € 2,064.12 for married couples and an additional € 201.88 for each child. The applicant must have health insurance providing benefits in Austria and covering all risks; family members of Austrian citizens are usually covered by their sponsors’ health insurance (co-insurance). The applicant must provide evidence of a legal title to accommodation adequate for the family size according to local standards. Social benefits due only once the title is granted are not permissible as evidence of subsistence.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Family members of Austrian nationals may file the application in Austria after lawful entry and during their legal stay, or at the competent Austrian embassy or consulate abroad; an application in Austria does not in most cases give a right to stay beyond the permitted visa or visa-free period. The authority must decide without undue delay, but not later than six months after receipt. The application fee is € 218. Evidence of German at A1 level is required when first applying for the Family Member title. The Family Member title allows time-limited settlement and gives unrestricted access to the labour market. Residence titles are, as a matter of principle, granted for twelve months; the Family Member title is issued for three years if the family member has completed Module 1 of the Integration Agreement and has resided lawfully in Austria without interruption during the previous two years. After five years of lawful settlement without interruption, a Long-term resident – EU title may be applied for if the general requirements have been met and Module 2 of the Integration Agreement has been completed.
