The permitted purpose is to remain temporarily in Australia specifically to pursue a workplace exploitation claim (types listed include underpayment of wages, pressure to work beyond visa conditions, pressure to surrender a passport, threats to cancel a visa, and bullying or harassment including sexual harassment); members of the family unit already in Australia can be included in the application.

What maximum stay, rolling-period rule, validity and entry rules apply?

The stay is 6 months, or up to 12 months depending on circumstances — the longer 12-month option requires the certification to be provided by a lawyer with specialist employment-law accreditation from their State/Territory Law Society, or with 5+ years of experience practising for an accredited third party.

What important funds, accommodation, invitation, insurance, onward-travel or passport evidence may be required?

The applicant must hold a temporary substantive visa with work rights with no more than 28 days remaining, or must have held one that ceased within the last 28 days, and must present certification of the workplace exploitation claim from a participating government agency or an accredited third party. Applicants (and any family members aged 16 or over applying with them) must meet health and character requirements, and must have adequate health cover for the whole stay.

Where/how is permission obtained when required, and under what important circumstances can a stay be extended or changed?

Applicants apply online while in Australia (but not in immigration clearance); the visa costs nil. Applicants must be able to support themselves and any accompanying dependants, must have no unpaid debt to the Australian Government (or a formal repayment arrangement), and — if aged 18 or over — must sign the Australian values statement; a prior visa cancellation or refused application may affect eligibility, and for applicants under 18 everyone with parental responsibility must consent to the grant, which might not be given if not in the child's best interests.
