Which family relationships qualify?

The qualifying family relationship is that of a biological, legal (including adoptive) parent, step-parent, or parent-in-law of the Parent Sponsor, who must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. Unlike the permanent parent visa categories, there is no balance of family test for this visa.

Who may sponsor or bring the family member, and what immigration/citizenship status must that person hold?

The applicant must have an approved Parent Sponsor, who must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, before they can lodge a visa application: sponsorship approval is a prerequisite step rather than something assessed alongside the visa application. Once the sponsorship is approved, the applicant must lodge their visa application within 6 months of that approval, or within 60 days if given permission to apply while already in Australia, which is only granted in limited circumstances.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

Relationship proof here is limited to establishing the parent, step-parent, or parent-in-law link to the sponsor and being at least 18 years of age; there is no minimum relationship duration or cohabitation test, since the visa is temporary and does not carry a balance of family test. The applicant must also demonstrate a genuine intention to stay in Australia only temporarily and do only what the visa allows.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The applicant must meet Australia's health and character requirements, must have met and complied with any previous visa obligations, must have or have access to enough money to support themselves in Australia, and must maintain adequate health insurance from an Australian provider for the duration of their stay. Any debt owed to the Australian Government, including a public health debt, must be repaid or under an arrangement to be repaid.

This is strictly a temporary visa with no pathway to permanent residence: the holder can visit Australia for up to 3 or 5 years per grant and can apply for further visas up to a maximum total stay of 10 years, but cannot work in Australia and cannot apply for a permanent or temporary parent visa while holding or having applied for this visa. The cost is AUD6,370.00 for a 3-year visa or AUD12,440.00 for a 5-year visa.
