Is this for a founder, startup entrepreneur, self-employed person, freelancer, company owner or another business profile?

This is the permanent-residency endpoint for existing 188 Business Innovation provisional-visa holders: it is for someone who already holds (or in certain cases held) a Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation stream or Business Innovation Extension stream, a Special Category visa (subclass 444), or in certain cases a subclass 457 visa, and wants to continue the business they already established while becoming a permanent resident.

What must actually exist or be demonstrated: business plan, company, innovation, clients, contracts, economic activity, job creation or other substance?

The applicant must show continuity of the business already built under the provisional visa: for the 2 years immediately before applying, an ongoing ownership interest in up to two main businesses in Australia, a direct and continuous senior management role, lodged Business Activity Statements, and an ABN for each main business, with an ownership stake of at least 51% (turnover under AUD400,000/year), 30% (turnover AUD400,000+/year), or 10% (publicly listed company).

What investment, capital, income, revenue, funding or viability evidence is central to this pathway?

Viability is shown through the existing business rather than fresh capital: an annual turnover of at least AUD300,000 in the 12 months before applying, plus at least 2 of: AUD200,000 net business assets, AUD600,000 net personal+business assets, or 2 full-time eligible employees. A second instalment charge of AUD4,890 applies to a family member 18+ without functional English who has not already paid it on a prior subclass 188 application.

The holder can stay in Australia permanently, continue operating the business, work and study, attend free AMEP English classes if eligible, enrol in Medicare, sponsor relatives to come to Australia, travel to and from Australia for 5 years from grant, and, if eligible, become an Australian citizen. Family unit members can be included at application or added any time before a decision, subject to health and character requirements.

What approval/application sequence applies, how long is the status granted, how is it renewed, and what longer-term residence direction is officially stated?

This visa is the permanent-residence outcome of the Business Innovation pathway: it is permanent from grant, with no further renewal needed to keep residing in Australia. Reaching it requires 1 year of physical presence in Australia within the preceding 2 years (if invited before 1 July 2021) or within the preceding 3 years (if invited on or after 1 July 2021). The travel facility runs for 5 years from grant, after which a Resident Return visa or Australian citizenship is the stated next step.
