The permit is issued by the local authority responsible for border and migration. The application is made online through the e-Albania portal link by the foreign national or a person authorised by them, supported by a request from the responsible authorities handling the foreign national that sets out the status or reason; a copy of the valid travel document is needed only if the person has one. Where there are reasonable grounds to believe the person is a victim or potential victim of trafficking, identified as such by the competent entities for the identification and referral of victims of trafficking, a three-month permit is issued regardless of the person's willingness to cooperate with justice.

What happens after the request: registration, family handling, major support and rights where officially stated?

Article 53 creates two distinct trafficking-victim residence permissions. For a victim or potential victim, the local border and migration authority may issue a type-A permit under Article 53(1)-(2), valid for one year and limited to stay in Albania without re-entry after departure; renewal under paragraph 2 is restricted to the stated security, justice-cooperation or pending-status situations. Separately, where responsible structures identify reasonable grounds to believe the person is a victim or potential victim, Article 53(4) provides a three-month type-A recovery and reflection permit regardless of willingness to cooperate, so the person can recover and decide whether to cooperate. During that period, statutory rights and services apply; paragraph 6 gives distinct grounds and written-notice requirements for revocation of this three-month permit. A holder under paragraphs 1-2 may stay and move within Albania and receive health care, financial assistance and support; lack of identity proof alone does not justify refusal. A victim or potential victim may work without prior AKPA approval, with the employer reporting employment through the electronic tax system. Paragraph 8 permits renewal when the identified victim’s stay is needed for personal/social reasons or justice cooperation, and paragraph 9 says a grant is not conditional on sufficient funds or identity documents. These provisions do not make the three-month permit automatically convert into the one-year permit.
